Torquay car park drama among new cases in court

Magistrates are ordinary members of the public who hear cases in court. They sit as a team of three and are sometimes known as justices.

The chair is known as the presiding justice but all three magistrates contribute to the decision-making. It is the presiding justice who addresses the court, the defendant and assembled legal representatives.

All criminal cases begin their life at the magistrates court. The most serious end up in crown court before a judge. Magistrates sentencing powers include unlimited fines, bans, community orders and up to a year in prison. They often hear cases of drink driving, drug taking, shoplifting and violent behaviour.

Here DevonLive looks at recent hearings at the magistrates' courts in Exeter, Newton Abbot and Barnstaple.

MARCH 7

Alexander Leslie Cross, C/O St Pauls Road, Clifton, Bristol. Age: 57. Between 01/03/2023 and 06/03/2023 at Exeter breached a restraining order. Plea: Guilty. Breach a suspended sentence imposed for breaching a restraining order. Committed to prison for 50 weeks.

Byron Roberts, Coach Road, Silverton. Age: 67. On 27/07/2022 at Crediton drove a mechanically propelled vehicle, namely a white Mazda 6 estate, on High Street without due care and attention and caused serious injury by the manner of driving to a female. Plea: Guilty. Community order made. Carry out unpaid work for 120 hours. Disqualified for holding or obtaining a driving licence for 18 months.

Rheianne Holly Taylor, Quarry Lane, Exeter. Age: 19. On 13/11/2022 at Exeter drove a motor vehicle, namely Ford Fiesta on Topsham Road when the proportion of a controlled drug, namely cannabis, in blood, namely 7.0μg/L, exceeded the specified limit. Plea: Guilty. Fined £350. Disqualified for holding or obtaining a driving licence for 18 months.

Robin Mayes, Old Quarry Drive, Exminster. Age: 47. On 13/02/2023 at Exminster drove a motor vehicle on a road namely, Sannerville Way, after consuming so much alcohol that the proportion of it in breath, namely 74 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £650. To pay a surcharge to fund victim services of £260. Disqualified from holding or obtaining a driving licence for 20 months.

Katrina Diane Weeks, School Close, Bampton, Tiverton. Age: 31. On 13/02/2023 at A396, Bampton drove a motor vehicle, after consuming so much alcohol that the proportion of it in breath namely 50 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £180. Disqualified from holding or obtaining a driving licence for 14 months.

Matthew Adrian Luke Welham, Myrtle Road, Exeter. Age: 34. On 14/02/23 at Exeter Police Station used threatening or abusive words or behaviour or disorderly behaviour within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby. Plea: Guilty. Discharged conditionally for 12 months.

Daniel Joshua Buckard, Rosebery Road, Exmouth. Age: 33. On 30/08/2022 at M5 Cullompton, drove a motor vehicle while disqualified from holding or obtaining a driving licence. Plea: Guilty. Community order made. Drug Rehabilitation Requirement. Fined £50. Disqualified for holding or obtaining a driving licence for 12 months.

Petrina Douglas, Beech Park, Holsworthy. Age: 49. On 06/06/2022 at A388, Holsworthy Beacon, drove a motor vehicle,on a road, after consuming so much alcohol that the proportion of it in blood, namely 129 milligrammes alcohol in 100 millilitres of blood, exceeded the prescribed limit. Plea: Guilty. Fined £650. Disqualified from holding or obtaining a driving licence for 14 months.

MARCH 8

Atisha Richard Tenzin Mullin, Duckspond Close, Buckfastleigh. Age: 36. On on the 09/01/January 2023 at Torquay when suspected of having driven a vehicle and having been required to provide a specimen of blood failed without reasonable excuse to do so and without a licence. Plea: Guilty. Community order made. Drug Rehabilitation Requirement. Fined £50. Disqualified from holding or obtaining a driving licence for 23 months.

Danny Osborne, Rutherford Street, Exeter. Age: 29. On 23/07/2022 at Torquay, at a designated football match held at Plainmoor, without lawful authority or lawful excuse, threw a red smoke bomb, at or towards the playing area. Plea: Guilty. Fined £120. Football banning order made for three years.

Matthew Luke Hilton, Combe Road, Torquay. Age: 26. On 12/01/2023 at Truro Avenue, Watcombe, drove a motor vehicle, namely red Peugeot 208 on a public place after consuming so much alcohol that the proportion of it in breath, namely 72 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £240. Disqualified from holding or obtaining a driving licence for 20 months.

Charlotte Mair, East Street, Newton Abbot. Age: 33. On 14/01/2023 at Tesco Newton Abbot drove a motor vehicle on a public place after consuming so much alcohol that the proportion of it in breath, namely 61 breath microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £120. Disqualified from holding or obtaining a driving licence for 17 months.

John David Matthews, The Old School Room, Brixham. Age: 47. On 13/01/2023 in Paignton drove a motor vehicle on Dartmouth Road, after consuming so much alcohol that the proportion of it in breath, namely 74 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £120. Disqualified for holding or obtaining a driving licence for 40 months.

Shane Peter Gifford, C/O Union Street, Torquay. Age: 45. On 02/09/2022 at Torquay had in a public place, namely Torre Valley car park torquay, an offensive weapon, namely wooden cricket stump, with which unlawfully and intentionally threatened another person, namely a PC. Plus assaulted a PC. Plea: Guilty. Committed to prison for 26 weeks suspended for 18 months. Alcohol Treatment Requirement. Cricket Stumps/Bat to be forfeited under Section 1(2) Prevention of Crime 1953 and destroyed. To pay compensation of £100.

Paul Andrew James Spear, Bitton Park Road, Teignmouth. Age: 40. On 11/02/2023 at Newton Abbot drove a motor vehicle, namely Range Rover Evoque on A38, Drumbridges, after consuming so much alcohol that the proportion of it in breath, namely 73 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit. Plea: Guilty. Fined £507. Disqualified from holding or obtaining a driving licence for 20 months.

James Hutt, Steeperton Close, Okehampton. Age: 38. Complaint for a Stalking Protection Order on the basis that have carried out acts associated with stalking, pose a risk associated with stalking to another person and there is reasonable cause to believe the proposed order is necessary to protect another from such a risk. Stalking Protection Order Made for two years. Costs of £500 to Devon & Cornwall Police.

John Alex Bosley, Summer Lane, Mincinglake, Exeter. Age: 57. On 17/06/2022 at Exeter without lawful excuse, damaged the road surface of Summer Lane, to the value of £129.69 belonging to Devon County Council. Plea: Guilty. Community order made. Fined £230. To pay costs of £500.00 to the Crown Prosecution Service. To pay compensation of £129.69.

Watermouth Castle Estates, Watermouth Castle, Berrynarbor, Ilfracombe. On or about 03/12/2021 at Watermouth Castle Estates, being an employer, failed to ensure, so far as was reasonably practicable, the health, safety and welfare at work of employee in the operation of attaching a cage to a loader and placing the employee inside to carry out work. Contrary to sections 2 and 33(1)(a) of, and Schedule 3A to, the Health and Safety at Work etc Act 1974. Plea: Guilty. Fined £12,000.To pay costs of £6,464.

Barry Fowler, Middle Knapp Farm, Putts Corner, Sidbury, Sidmouth. On 23/06/2021 at a field at Middle Knapp Farm, failed to conduct undertaking in such a way to ensure, so far as was reasonably practicable, that persons who may have been affected were not exposed to risks to their health and safety, and those who used a public right of way across a field in which cattle with calves hoof grazed, were not exposed to risks to their health or safety. Plea: Guilty. Fined £525. To pay costs of £3,000.

MARCH 9

Jake Francis Alford, Raleigh Drive, Cullompton. Age: 29. On 07/01/2023 at Cranbrook breached a restraining order. Plea: Guilty. Community order made. Fined £50.

Mr Luke Robert Down, NFA. Age: 36. On 07/03/2023 at Royal Devon And Exeter Hospital assaulted an emergency worker, namely an NHS nurse acting in the exercise of his functions as such a worker. Plea: Guilty. Committed to prison for 12 weeks. To pay compensation of £79.

Robert William Trevelyan, Briar Crescent, Exeter. Age: 33. On 08/09/2022 in Exeter drove a motor vehicle on a road, namely Shakespeare Road, when the proportion of a controlled drug, namely delta-9-tetrahydrocannabi nol (cannabis breakdown), in blood, namely 7 microgrammes per litre of blood, exceeded the specified limit. Plea: Guilty. Fined £280. Disqualified for holding or obtaining a driving licence for 12 months.

Jake Pringle, Codrington Street, Exeter. Age: 25. On 28/10/2022 at Exeter had in possession a quantity of cannabis. Plea: Guilty. On 28/10/2022 at Exeter drove a mechanically propelled vehicle, on a road, namely Parr Street, whilst unfit to drive through drugs. Plea: Guilty. Community order made. Carry out unpaid work for 160 hours. Disqualified for holding or obtaining a driving licence for 14 months.

MARCH 13

Nicholas John Moore, Bevan Road, Barnstaple. Age: 51.Between 22/06/2020 and 24/06/2020 at Barnstaple without reasonable excuse, sent unwanted text messages while prohibited from doing so by a restraining order. Plea: Guilty. Fined £200.

Nicholas Terence Forty, New Street, Honiton. Age: 44. Between 07/01/2023 and 10/01/2023 at Honiton pursued a course of conduct which amounted to the harassment of a female. Plea: Guilty. Community order made. Abstain from consuming any alcohol throughout a period of 70 days. Thinking Skills Programme. Restraining order made.
